SHORT TERM RENTAL AGREEMENT

By acceptance of the terms of this Short Term Rental Agreement, both Guest and Homeowner are hereby bound by these terms as soon as payment is made.

This Short Term Rental Agreement is made by and between North Point Professionals, LLC (“Homeowner”) and The Party whose name is on the Venmo account or personal check by which this reservation and payment is being made (“Guest”). The effective date of this agreement shall be the date confirmed via text message or email. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located at: 378 Windy Pass Trail, Big Sky, Montana. The property is 100% furnished as a personal residence including linens and towels. The kitchen is fully stocked with all necessary utensils to prepare meals in-residence. While there may be some food staples left by previous guests, Guest should assume that there are no foodstuffs furnished.

2. Rental Party / Occupancy: The rental party shall consist of Guest and the number of adults and children mentioned in the booking request. Homeowner may request and Guest agrees to provide a list of the names and ages of each of the people composing the Rental Party. The maximum number of guests is limited to 10 persons unless otherwise agreed to in advance, via email by Homeowner. Guests not disclosed on the Rental Party list (unauthorized guests) will be politely asked by Property Manager and expected to leave the premises upon discovery unless subsequent permission is granted by local Property Manager.

3. Term of the Rental. Check-in begins at 2 pm on the first reservation date and Check-out time is 11 am on the final date of the reservation.

4. Rental Rules: Guest agrees to abide by the Rental Rules at all times and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property. Guest shall apply the “Golden Rule” to their personal conduct while in residence. Guest acknowledges the property is located in a residential community and as such, personal conduct must be respectful of the Homeowner’s physical property and of the rights and expectations of neighbors. Guest agrees there shall be NO SMOKING and NO PETS inside or on the property. Also note: the property is located in bear country. Guest is responsible for bringing garbage out to bear-proof garbage cart.

5. Condition of Property. Homeowner has, to the best of its ability, given an accurate description of the Premises and Property and its condition. All electrical, plumbing and appliances should be in working order. The failures of operation of certain extra amenities, such as television, or Internet and WiFi service are not a basis for any refund. Homeowner will make every reasonable effort to have items repaired but does not guarantee the repair during Guest’s occupancy. Under no circumstances will any rental amounts be discounted or rental money be refunded or returned because of the condition of the Premises. Guest agrees to hold Homeowner harmless from any liability for the condition of the Premises. There shall be no discounts of rental amounts due and no refunds of rents due to shortened stays or ruined expectations because of weather conditions, or due to work and family emergencies or other commitments.

6. Access: Guest shall allow Homeowner and/or Property Manager immediate access to the property for purposes of repair and/or inspection. Every effort shall be made to provide advance notice to Guest of any intent to enter the property. Homeowner and/or Property Manager shall exercise this right of access in a reasonable manner.

7. Indemnification. It is the Guest’s responsibility to learn about safety procedures concerning the Premises and Property. Guest agrees to have a responsible adult supervising minors while and during recreation activities. Guest is hereby notified that the Property can be dangerous, and Guest accepts fully any, and all the risks involved. Guest acknowledges and assumes all risk of the premises and property. Guest expressly indemnifies and holds homeowner harmless from any and all actions, accidents, damages to property or persons and injuries from or arising out of the premises or property. Guest acknowledges and understands no special efforts have been made to “childproof” the Premises or Property, and Guest accepts any and all risk or harm to any children upon the Premises and Property. The Premises has fire alarms installed and are believed to function properly at the time of rental. Guest will notify management without delay if a fire alarm chirps or has a low battery condition. Guest shall see to Guest’s own security while in, on or upon the Premises and the Property by locking doors, windows, etc. Under no circumstances will Guest or their guests hold Homeowner responsible for any damages or claims of any kind resulting from their rental of the Premises or use of the Property, except for intentional acts of harm.

8. Rental Rate and Fees. Homeowner accepts payment by Venmo or personal check. The acknowledgement of receipt of payment will be provided by text to Guest, and is Guest’s actual rental rate, rental dates, and rental payment confirmation.
